1. Acceptance of Terms

By accessing this website or utilizing the bonding services of Freedom Way Bail Bonds, you agree to comply with and be bound by these Terms of Service, applicable North Carolina laws (including N.C. Gen. Stat. Chapter 58, Article 71), and court rules governing bail bonding.

2. Bail Bond Services & Statutory Premiums

Freedom Way Bail Bonds operates as a state-licensed bail bond agency regulated by the North Carolina Department of Insurance. In accordance with North Carolina law (N.C. Gen. Stat. § 58-71-95):

• Statutory Premium Cap: The bail premium charged by a professional bondsman cannot exceed 15% of the face amount of the bond.
• Earned Fee: The premium is fully earned upon posting the bond and securing the defendant's release. Premiums are strictly non-refundable.
• Collateral Return: Any collateral pledged is held in trust and returned upon final disposition of the case and formal exoneration of the bond by the court.

3. Indemnitor & Defendant Obligations

Clients and indemnitors (co-signers) agreeing to bail contracts acknowledge:

• The defendant must appear at all scheduled court dates, hearings, and required proceedings until the case is officially closed by the court.
• Failure to appear triggers bond forfeiture proceedings, during which the indemnitor remains liable for all costs incurred in locating and returning the defendant to custody.
• All information provided regarding residency, employment, and case details must be truthful and accurate.
