Appearance Bonds in North Carolina

An appearance bond is the defendant's — or a bondsman's — written commitment that the defendant will show up for every scheduled court date. It's the most common release mechanism in NC district and superior courts, and the one most people mean when they say "bail bond."

What makes it an "appearance" bond

The court cares about one thing: showing up.

An appearance bond's entire purpose is to guarantee the defendant returns for every court date — arraignment, motions, and trial. It's distinct from a straight cash bond (full amount paid to the court directly) because we, as a licensed surety, take on that guarantee on your behalf for a fraction of the bond's face value.

North Carolina courts can set an appearance bond as secured (backed by cash, property, or our surety) or unsecured (a written promise with no upfront payment, usually reserved for lower-risk defendants). Most bonds we write are secured through our surety license.

What happens if a date is missed

The bond doesn't disappear — it gets called.

If a defendant misses a scheduled court date, the court can order the appearance bond forfeited, meaning we — and by extension the co-signer — are on the hook for the full bond amount unless the defendant is located and brought back before the deadline. This is why we call and text ahead of every date on record. If a date was genuinely missed by accident, tell us immediately — there are sometimes options to get back in front of the judge before forfeiture becomes final.

Cost & payment

One statute-capped premium.

North Carolina statute caps what we can charge as a percentage of the bond's face value — we quote that figure on the first call, before any paperwork moves. Payment plans are available on most bonds so the premium doesn't have to come out of one paycheck.

What defendants and families ask.

An appearance bond is the legal instrument the court sets to guarantee court dates; a surety bond is how we — as a licensed insurance-backed company — post that appearance bond on your behalf for a premium.

Yes, for lower-risk defendants a judge can set an unsecured appearance bond, meaning no payment is required unless the defendant misses court. Most bonds we write are secured.

The full bond amount becomes due unless the defendant is located and returned to custody before the forfeiture becomes final. Contact us immediately if a court date was missed.
